3D Print Service Agreement and Disclaimer – Digitize3D.ca

This 3D Print Service Agreement and Disclaimer (“Agreement”) governs the use of the 3D print service (“Service”) provided by Digitize3D.ca (“Company”) for the purpose of designing and manufacturing three-dimensional objects (“Printed Items”). By using our Service, you agree to the terms and conditions outlined in this Agreement.

1. Design and Specifications

Digitize3D.ca strives to accurately replicate the design and specifications provided by the customer (“Customer”). However, slight variations in color, texture, and dimensions may occur due to the nature of 3D printing technology. Digitize3D.ca does not guarantee an exact match to the provided specifications.

2. Craftsmanship Disclaimer

Each item is produced through a precise 3D printing process. Due to the nature of additive manufacturing, slight imperfections such as small marks, layer lines, or minor inconsistencies in finish may be present. These are typical of 3D printed objects and do not affect the functionality or intended aesthetic of the product. While we aim to produce the highest quality product, some variability is inherent in the process.

3. Material Selection

The Customer is responsible for selecting appropriate materials for the Printed Items. Digitize3D.ca may provide recommendations; however, it is the Customer’s responsibility to ensure the selected material is suitable for its intended use.

4. Intellectual Property

The Customer warrants that they have the necessary rights or permissions to use any design, model, or content submitted for printing. Digitize3D.ca is not responsible for any intellectual property disputes arising from Customer submissions.

5. Copyrighted Material

The Customer acknowledges that Digitize3D.ca is not liable for any copyright infringement resulting from printed content. It is the Customer’s responsibility to ensure submitted designs do not violate third-party rights.

6. Quality and Inspection

Digitize3D.ca strives to ensure high-quality Printed Items. The Customer must inspect all items upon receipt. Any claims regarding defects or discrepancies must be submitted within 7 days of receipt.

7. Prohibited Use – Children’s Products & Safety Warning

Digitize3D.ca does not manufacture or supply toys or products intended for use by children.

3D printed items may contain small parts, sharp edges, or material characteristics that can present choking hazards or injury risks if used improperly. These items are not designed, tested, or certified for child safety.

Under no circumstances should Printed Items be used as toys or given to children for play. Digitize3D.ca shall not be held liable for any harm, injury, or damages resulting from misuse, including ingestion or improper handling by a child.

8. Liability and Indemnification

Digitize3D.ca shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Service or Printed Items. The Customer agrees to indemnify and hold Digitize3D.ca harmless from any claims, losses, or liabilities resulting from their use of the Service.

9. Safe Use and Compliance

The Customer is responsible for using Printed Items safely and in compliance with all applicable laws, regulations, and safety guidelines. Digitize3D.ca is not responsible for any harm, injury, or damage resulting from misuse or improper application.

10. Modification and Termination

Digitize3D.ca reserves the right to modify, suspend, or terminate the Service at any time without prior notice. Access may be revoked if the Customer violates this Agreement.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada.

Acknowledgment

By using this Service, the Customer confirms they have read, understood, and agreed to the terms outlined in this Agreement.
